Peach Suite Pro Terms of Service

Acceptance of Terms
By accessing or using Peach Suite Pro, you agree to be bound by these Terms of Service.
Peach Suite Pro is a software platform developed and owned by Just Peachy Data.
Description of Service
Peach Suite Pro provides business management tools that may include scheduling, client management, health and intake records, reporting, inventory management, communications, and other related services.
Features may change without notice.
User Accounts
Users are responsible for maintaining the confidentiality of their account credentials and all activity occurring under their accounts.
Customer Data
Users retain ownership of the information they enter into Peach Suite Pro.
By using the platform, users grant Just Peachy Data the limited rights necessary to host, process, secure, back up, and transmit such information solely for providing the service.

SMS Messaging Compliance
Customers using Peach Suite Pro SMS functionality are responsible for obtaining all required express consent from message recipients and complying with applicable federal, state, carrier, and industry requirements.
Where applicable, customers are responsible for obtaining and maintaining their own approved A2P 10DLC Brand and Campaign registrations before enabling SMS messaging.
Failure to comply may result in suspension or termination of messaging functionality.
Data Processing
Peach Suite Pro processes customer data solely for the purpose of providing the services requested by its users. Just Peachy Data acts as the software provider and processes data only as necessary to host, maintain, secure, back up, transmit, and improve the platform. Customer data remains the property of the customer.
Acceptable Use Policy
Users agree to use Peach Suite Pro only for lawful business purposes and in compliance with all applicable federal, state, and local laws and regulations.
Users may not:

AI Features Disclosure
Peach Suite Pro may include artificial intelligence features designed to assist users with messaging compliance reviews, content suggestions, business insights, reporting, workflow recommendations, and other productivity functions.
AI-generated content is provided for informational and assistance purposes only. Users remain solely responsible for reviewing, editing, approving, and verifying all AI-generated content before use.
Just Peachy Data does not guarantee the accuracy, completeness, legality, or suitability of AI-generated recommendations.
SMS Messaging Compliance
Customers using Peach Suite Pro SMS functionality are responsible for obtaining all required recipient consent and complying with applicable laws, regulations, carrier policies, and industry standards.
Where required, customer businesses must establish and maintain their own approved A2P 10DLC Brand and Campaign before SMS functionality is enabled.
Peach Suite Pro includes compliance tools designed to assist customers with messaging requirements; however, ultimate responsibility for compliance remains with the customer.
Just Peachy Data reserves the right to suspend or disable messaging functionality that appears to violate carrier requirements, applicable law, or platform policies.
Subscription and Billing
Subscription fees are billed according to the customer's selected service plan.
Unless otherwise stated in a written agreement, subscriptions automatically renew at the end of each billing period until cancelled.
Customers may cancel future renewals in accordance with the cancellation procedures provided within the platform.
Fees already paid are non-refundable except where required by law or expressly stated in a separate agreement.
Just Peachy Data reserves the right to modify pricing or service plans with reasonable advance notice.
Failure to pay subscription fees may result in suspension or termination of access to Peach Suite Pro.
Service Availability
Just Peachy Data strives to maintain a reliable and secure platform but does not guarantee uninterrupted or error-free service.
Scheduled maintenance, security updates, third-party outages, internet disruptions, or circumstances beyond reasonable control may temporarily affect platform availability.
Data Backup and Recovery
Peach Suite Pro performs reasonable system backup procedures intended to support business continuity and disaster recovery.
Although backups are maintained, customers are encouraged to retain copies of important business records. Just Peachy Data is not responsible for data loss resulting from events beyond its reasonable control.
Third-Party Services
Peach Suite Pro may integrate with third-party providers, including payment processors, messaging providers, email providers, cloud hosting providers, and other business services.
Use of third-party services is subject to the respective provider's terms and privacy policies.
Just Peachy Data is not responsible for the products, services, availability, or policies of third-party providers.
Limitation of Liability
To the fullest extent permitted by law, Just Peachy Data shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the use of Peach Suite Pro, including loss of profits, business interruption, or loss of data.
The total liability of Just Peachy Data for any claim arising from the use of the platform shall not exceed the amount paid by the customer for the service during the twelve (12) months preceding the claim, to the extent permitted by applicable law.
Platform Availability
Just Peachy Data strives to provide reliable service but does not guarantee uninterrupted availability. Maintenance, upgrades, and unforeseen events may temporarily affect service.
Third-Party Integrations
Peach Suite Pro may integrate with third-party providers including payment processors, messaging providers, email providers, and other services. Just Peachy Data is not responsible for the services or policies of third-party providers.
Intellectual Property
Peach Suite Pro, its software, branding, graphics, documentation, and content are the property of Just Peachy Data and are protected by applicable intellectual property laws.
Limitation of Liability
To the fullest extent permitted by law, Just Peachy Data shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use Peach Suite Pro.
Indemnification
Users agree to indemnify and hold harmless Just Peachy Data from claims arising from their misuse of the platform or violation of these Terms.
Termination
Just Peachy Data may suspend or terminate access for violations of these Terms or for activities that threaten platform security or regulatory compliance.
Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
Changes to These Terms
Just Peachy Data may modify these Terms from time to time. Continued use of Peach Suite Pro after changes become effective constitutes acceptance of the revised Terms.
